Homeless Education Act

The McKinney-Vento Homeless Education Act provides rights for families who live in the following situations: a shelter, motel, vehicle or campground, on the street, trailer or other inadequate accommodations, or 'doubled up' with friends or relatives. Homeless students by this definition have the right to:

  • Receive the same public education provided to other students;
  • Continue in the school the student last attended;
  • Receive transportation to the school the student attended before becoming homeless;
  • Attend a school and participate in school programs with students who are not homeless;
  • Enroll in a school without giving a permanent address (schools may not require proof of residency that might prevent or delay school enrollment);
  • Enroll in a school while the school arranges for transfer of immunization records; and
  • Receive the same special programs and services as provided to all other students.
